CraigVM62 0 Posted March 12, 2006 Was reading on a motorcycle forum where the subject of CCTV Systems came about. A person stated that in his area "So. Ca" unless you have signs warning that cameras are recording video material, any material that is recorded can not be used as evidence against the criminal. Was wondering if the individual was confused, or if such laws do exist ???
securitymonster 0 Posted March 12, 2006 I believe it varies from state to state. In Oregon you don't have to post signs unless you are recording audio. You might just call the local police to see what they have to say!
CSG 0 Posted March 12, 2006 In NY you don't need to post signs. However many do for the deterrence effect. Audio might be different, it tends to come down to the reasonable expectation of privacy. While no one would have an expectation of privacy to be seen (video) while on the street, a conversation between two people on the street would be assumed to be private from being monitored by a third person. I am sure there is some exceptions, but I don't know what they are off hand. If it is a publice place in general they can be recorded.
rory 0 Posted March 13, 2006 no signs at all needed here, though they can be helpful sometimes ... Course if the criminal cant read or doesnt know what a CCTV Camera looks like, then ... well ..
cctvsussex 0 Posted June 25, 2006 That’s interesting over here in the UK we’ve got a heap of red tape. In the UK all non domestic cctv installations must have warning signs when your entering the area under surveillance. It must display the name of the organisation and contact details too. Also you have to be registered with the Information Commissioners’ office under the Data Protection Act. Which looks like this Purpose 5 Crime Prevention and Prosecution of Offenders Purpose Description: Crime prevention and detection and the apprehension and prosecution of offenders. Data Controllers further description of Purpose: INCLUDES USE OF CLOSED-CIRCUIT TELEVISION FOR THE MONITORING AND COLLECTION OF SOUND AND/OR VISUAL IMAGES FOR THE PURPOSE OF MAINTAINING THE SECURITY OF PREMISES, FOR PREVENTING CRIME AND INVESTIGATING CRIME. Data subjects are: Customers and clients Offenders and suspected offenders MEMBERS OF THE PUBLIC THOSE INSIDE, ENTERING OR IN THE IMMEDIATE VICINITY OF THE AREA UNDER SURVEILLANCE Data classes are: Personal Details Goods or Services Provided Offences (Including Alleged Offences) Criminal Proceedings, Outcomes And Sentences. SOUND AND/OR VISUAL IMAGES PERSONAL APPEARANCE AND BEHAVIOUR Sources (S) and Disclosures (D)(1984 Act). Recipients (1998 Act): SECURITY ORGANISATIONS Data subjects themselves Business associates and other professional advisers Employees and agents of the data controller Suppliers, providers of goods or services Persons making an enquiry or complaint Police forces Transfers: None outside the European Economic Area all the best james
Cooperman 0 Posted June 26, 2006 Hi cctvsussex, and welcome. To be strictly accurate, when it comes to CCTV, not all businesses need to register under the Data Protection Act. The requirement for notification and compliance is based on the way in which a system is used. Apparently, following a court direction about eighteen months ago, it was decided that where a system is being used 'passively', with nobody actively monitoring the activities of individual "Data Subjects", then it is exempt from the requirement to notify. I wonder why the words 'joke' and 'absolute' suddenly spring to mind
